Problems inevitably arise between employee and employer and, although best resolved informally, often need to be dealt with on a more formal basis. The Employment Act 2002 of statutory dispute resolution procedures introduced a new framework for a compulsory system of resolving workplace disputes. The full detail is contained in the Employment Act 2002 Dispute Resolution Regulations 2004 and came into force on 1st October 2004.

Since October 2004, the Employment Act 2002 and Employment Act 2002 Dispute Resolution Regulations 2004 introduced a compulsory procedure for employers to follow when contemplating dismissing and in limited circumstances, disciplining employees. Failure by an employer to comply with the procedures could result in:

  • An automatic finding of unfair dismissal irrespective of the strength of the employer's underlying case; and
  • An increase in compensation of between 10-50%.
