Fiancee of singer Gerry Rafferty to make a claim against his estate
The fiancée of late singer Gerry Rafferty is to make a claim against his estate after she was left out of his Will. Enzina Fuschini met Mr Rafferty in 2008 and they got engaged on Christmas Eve in 2009. However, his Will, which was made in 2007 before the couple met, leaves his entire £1.2m fortune to his daughter Martha Rafferty and granddaughter Celia Rafferty. The estate includes his home in California and the on-going rights to royalties from his music.
Ms Fuschini is taking her claim under the Inheritance (Provision for Family and Dependants) Act 1975. The Act provides that a partner who has been ‘living as husband and wife’ with the deceased for a period of two years prior to the date of death may be entitled to reasonable financial provision from the estate. Claims must be made within 6 months of the date of the grant of probate. In making its decision the Court will have regard to the financial needs and resources of the beneficiaries of the estate as well as the Claimant.
Mr Rafferty died in January last year at the age of 63 of organ failure following a long standing battle with alcoholism. Ms Fuschini, a mother of three, spoke of Rafferty and their romance shortly after he died. She said “I wanted to help him overcome his alcohol addiction and he desperately wanted to change. When I saw the unkempt state of his hotel room I realised he was suffering like a wounded animal. He pleaded with me to stay. I felt a surge of compassion and just wanted to look after him.”
