Apply for probate
It is likely that you will require the assistance of a Solicitor in order to obtain Probate.
How do I apply for Probate?
Whilst it is possible for an Executor to apply personally at the Probate Registry for the grant of probate the extent of the personal responsibilities and liabilities imposed on executors should counsel caution against this course of action. Instructing a solicitor to obtain the grant and administer the estate provides an assurance that risks to the executors are minimised.
Our experienced and friendly Probate department will be able to assist in the following:
- Valuing the assets and liabilities of the deceased's estate.
- Finalising the tax affairs of the deceased.
- Contacting and tracing the beneficiaries of the estate.
- Advising on the terms of the deceased's Will or if there is no Will applying the Intestacy rules to the estate.
- If the estate is over the Inheritance Tax Threshold, completing the IHT200 Inheritance Tax return.
- Preparing an Oath for Executors and submitting this to the Probate Registry.
- Distributing the estate in accordance with the terms of the Will.
We will have an initial meeting with you to discuss the deceased's estate and give you an idea of the work likely to be involved in the administration of the estate.
We will provide you with costs information from the outset and throughout so that you are aware of the fees involved.
If you want to make sure of the future for your loved ones then give us a call on 01604 828282 or 01908 660966. Alternatively you can fill out our online contact form for immediate completion and send it to us. Our Wills and Probate department are always on hand to help.
