Acquisition of Collingtree Park Golf Club

Following a series of negotiations, the members of Collingtree Park Golf Club instructed us to act on the purchase of the clubs assets from its owners. This also involved the negotiation of a lease over the golf course with the land owners.

The transaction depended on funds being raised within the membership. Our instructions were to deal with due diligence investigation, the negotiation of an Asset Purchase Agreement and investigate the title in respect of the lease. As lead lawyer, Simon Long was invited to join the committee on a series of calls relating to the transaction.

Working closely alongside the committee and their external Accountants (David Owens at Hawsons), Simon Long and his team managed to complete the transaction allowing the club to be run by its members for its members. Notwithstanding that COVID restrictions terminated the ability to play golf for a period during the transaction, the members were committed to the transaction and its legal completion.

Since the purchase completed, the membership of the Golf Club has grown significantly. The transaction had a number of difficulties, mainly in relation to the lease for the golf course, but with determination, commerciality and a desire from the members to own the Golf Club, Franklins were able to complete the transaction and place the Golf Club in the hands of its members.
