What Are Court Tracks?

The Civil Procedure Rules provide for three distinct tracks in the County Court system:

1. Small Claims Track

  • For claims under £10,000
  • Designed for simple disputes
  • Costs are limited, and parties are usually expected to represent themselves
  • Often used for low-value debt recovery

2. Fast Track

  • For claims between £10,000 and £25,000
  • Suitable where the trial is likely to last no more than one day
  • Court sets a timetable for key stages like disclosure and witness evidence
  • Legal representation is permitted and costs are proportionate to the case

3. Multi-Track

  • For claims over £25,000, or where there are complex issues of fact or law
  • Flexible case management by the court
  • Involves tailored directions and more detailed preparation for trial
  • Typically applies to business-critical or high-value disputes

How Is a Track Decided?

After both parties have submitted their claim and defence, the court will usually request a Directions Questionnaire. Based on this and other available information, the judge will decide which track is most appropriate.
