Alternative Dispute Resolution (ADR)
Although many people think of litigation as referring to court action, it really just means the legal process of resolving a dispute. In many cases it is preferable to avoid court action as this can be expensive, time consuming and stressful. Keeping a dispute out of court can also allow you to keep the matter private, which can allow you to avoid any unwanted publicity and help to protect your reputation.
Alternative Dispute Resolution (ADR) is the process of resolving disputes without resorting to court action. There are various methods that can be used, but two of the most common are mediation and collaborative law.
Mediation – This is where the parties involved in a dispute meet with a trained, neutral mediator to discuss their issues and attempt to agree a mutually acceptable solution. This approach is increasingly popular for issues surrounding divorce, as well as for a variety of other personal and business disputes.
Collaborative law – This relies on both parties in a dispute sitting down, each supported by their own lawyer trained in collaborative law to negotiate an outcome that works for everyone. This can be a good choice where there are more complicated issues to resolve so having trained legal advice on hand for both parties can save time and confusion.
There are also other options, such as Early Conciliation (EC) via the Advisory, Conciliatory and Arbitration Service (ACAS) for employment disputes that may be worth exploring depending on the specific type of dispute and the circumstances.
